This Privacy Notice concerns Happeo’s (“Happeo”, “we” or “us”) personal data processing in the context of the Happeo website www.happeo.com (“Website”) and Happeo’s social intranet platform accessible through the Website (“Happeo Platform”). Together, these are referred to as the “Services”.

  6. Technical Data includes IP address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access Happeo Platform or this website.

  7. Marketing and Communications Data includes your preferences in receiving marketing communications from us and our partners and your communication preferences.

  8. User Data includes your user ID to Happeo Platform and access tokens.

  9. Feedback includes feedback and claims made by you.

The above data may also include information about you that is publicly available, such as information available on sites like LinkedIn, Twitter, Facebook and Google.


SOURCES OF DATA

The personal data we collect and process is largely provided by yourself. With respect to potential customers and their contact persons, we also receive personal data from external or public sources, as we constantly look for new companies whom we think may benefit from our services. These sources include services such as Zoominfo, LeadIQ and Linkedin.

Some data is also generated during your use of the Website or Happeo Platform. When you visit the Website, you are not required to provide any Contact Data. However, when you contact us via the chat function on the Website or when you sign up to receive information from us, you are required to provide some Contact Data.

Legitimate grounds for processing

PERSONAL DATA RECIPIENTS

Personal data is mainly stored in electronic format and only authorised personnel within our organisation have access to the data.

Our services integrate some services provided by third parties. We may share some of your information with these service providers in order for them to provide their services, including removing repetitive information from prospect lists, analysing data, providing marketing assistance, conducting customer and/or user profiling, and providing customer service. As such, the terms and privacy policies of these service providers may apply to you as well, in particular: Google Analytics, Hubspot, Zoominfo, Google Optimize, Google Adwords, Capterra, Google Tag Manager, Google Recaptcha, LinkedIn, Twilio, Hotjar, Funnelytics, Clearbit, Amplifier, Grow, LeadIQ, Segment, and Zendesk.

To the extent the third parties act on Happeo’s behalf as data processors, Happeo seeks to conclude data processing agreements with each service provider before third party services are implemented into Happeo’s services in order to ensure that your personal data is used, stored, and transferred securely and in accordance with European Union law. This Privacy Notice does not apply to the services of the third parties to the extent the services are provided by the third parties acting as data controllers and are governed by their own policies and terms.

We may also disclose or transfer personal data to fulfil legal obligations or when a supervisory authority requires a disclosure. We may also disclose personal data if we are a subject to certain business activities such as merger or an acquisition or a funding process.

 

TRANSFERS OUTSIDE THE EEA

In order to provide our services, we transfer personal data outside the European Economic Area if our service provider is located there.

If personal data is transferred outside the European Economic Area, we make sure that (i) the transferee is located in a country with adequate safeguards (as decided by the EU commission from time to time), or (ii) the transfer occurs by using appropriate safeguards such as Standard Contractual Clauses published by the EU commission.

 

DATA STORAGE PERIOD AND SECURITY

We will not store personal data for a longer period than is necessary for its purpose or required by contract or law. The retention periods for personal data may vary based on its purpose and the situation. The retention periods may also be based on applicable laws (e.g. accounting, tax laws, employment contracts act). We may also update data from time to time. You may contact us in order to get detailed knowledge about the retention times of the data we have about you.

Personal data is stored and secured in accordance with general industry standards and practices. We consider and keep personal data confidential. Subcontractors that we use for processing personal data are selected also based on their data security measures. For our own systems and data storage, we use only well-established service providers and robust software tools. Access to personal data is also protected with user-specific logins, passwords and user rights. Our premises are also safe and secure.

You have the right to know whether we are processing personal data concerning you and also to know what data.

Right to withdraw consent

If we process personal data based on your consent, you can withdraw your consent at any time by contacting us. Withdrawing a consent may lead to fewer possibilities to use our services. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

Right to rectify

You have the right to request that we correct any inaccurate or outdated personal data we have about you by contacting us.

You have the right to request that your personal data is not processed for direct marketing purposes.

Right to unsubscribe marketing communications

Right to object

If we process your personal data based on Happeo’s or a third party’s legitimate interest, you have the right to object to the processing of your data, to the extent that there is no such significant other reason that would override your rights or the processing is not necessary for handling legal claims. Please notice that in this situation we may not be able to serve you anymore.

Right to restriction of processing

You may request us to restrict processing of personal data for example when your data erasure, rectification or objection requests are pending and/or when we do not have legitimate grounds to process your data. This may lead to fewer possibilities to use our services.

Right to data portability

If we process your personal data based on your consent or fulfilling of a contract, you have the right to request transfer of the data you have provided to us to another service provider in a commonly used electronic format.

How to use the rights

You can exercise your rights by sending us an email to dpo@happeo.com. In such a case, we are required to verify your identity, for example with a written and signed (and scanned) request, or a copy of your personal ID, but without social security number and other such information that we don’t need. If you consider that the processing of your personal data is not lawful, you can also make a notification to a supervisory authority.

In the following we will tell you which types of personal data we may collect about you and how we collect it. In section 3 we have in a table explained the purposes for which we process your personal data and the lawful basis we rely on.

Recruitment Data includes the information collected in the process of recruiting you, such as information you have included in your application and CV; including documentation and information about your education, previous work experience, qualifications, language skills, any photos, video or other recorded material which you at your own discretion chooses to make available to us.

  3. References includes information obtained from previous employees at our request.

  4. Work Permits includes information on your passport, citizenship, residence and work permit where needed.

  6. Qualification records includes authorisations and certifications, professional experience, qualifications and training records.

 

The information is collected directly from you by your application, CV or other material made available to us before or during interviews; we also process personal data from candidate profiles you are uploading to recruitment platforms.

4. SHARING OF INFORMATION COLLECTED

We may disclose your personal data within the Happeo Group where required for the above specified purposes. We base this processing on our legitimate interest to transmit personal data within the Happeo Group for internal administrative purposes, such as for the purposes of using centralized IT systems and alignment of Group HR Administration, and business operations and strategies. We may disclose personal data to third parties:

  • when it is necessary for the purposes listed in section 3

  • when required by law we may disclose your personal data to public authorities

  • we may assign your personal data, to any person or entity that acquires all or substantially all of our business, stock or assets, or with whom we merge.

  • when we believe in good faith that disclosure is necessary to establish or exercise our legal rights or defend against legal claims, protect your safety or the safety of others, investigate fraud, or respond to a government request.

We share information, including personal information, with our trusted third-party service providers that we use to provide services to us and process your data on our behalf and under our instruction, e.g. hosting of data and maintenance IT-systems, hosting and maintaining recruitment portals and platforms, certain recruitment services and test providers. These third-party service providers may have access to or process your personal information for the purpose of providing these services for us. We do not permit our third-party service providers to use the personal information that we share with them for any other purpose than in connection with the services they provide to us. We have entered into data processor agreements with our data processors.

We may also share information with third parties that act as independent controllers regarding the personal data. This includes [•] firms and other institutions that independently decide the purposes and means of personal data processing.

 

5. TRANSFER TO THIRD COUNTRIES

We will not transfer your personal data to recipients outside EU or EEA unless we have ensured compliance with GDPR Chapter V.

Some of our third-party service providers are established outside the EEA so their processing of your personal data will involve a transfer of data outside the EEA. However, to ensure that your personal information receive an adequate level of protection we have ascertained that sufficient safety measures have been implemented to allow for the transfer, including where the European Commission have deemed the country to provide an adequate level of protection for personal data; or by use of specific contract clauses approved by the European Commission (Standard Contractual Clauses) which give personal data essentially equivalent protection as it has in the EEA.

6. DATA RETENTION

We retain the personal information we collect where we have an ongoing legitimate need or obligation to do so. Where we are no longer obliged to keep your records and do not have an ongoing need to process your personal information, we will either delete or anonymize it.
In relation to applicants who are not offered employment we will normally delete all data within 12 months from the decision not to offer employment. We will retain applicant data for longer periods if the applicant has consented.

For applicants who are hired personal data will be retained in accordance with our Privacy Notice for Employees.

Data may be retained for longer period if we are legally obliged to do so, or if retention is necessary to establish, exercise or defend legal claims. For specific retention times, please contact us at dpo@happeo.com.

 

7. HOW TO EXERCISE YOUR DATA PROTECTION RIGHTS

You have certain choices available to you when it comes to your personal information. Below is a summary of those choices, how to exercise them and any limitations.
